Schorr Law is pleased to announce that our lead attorney, Zachary Schorr, recently spoke in a Strafford live video webinar, “Navigating Easement Disputes: Defining the Easement, Drafting to Mitigate Risk, Settlement and Litigation Strategies”.
Easements are rights that grant one party the use of another’s property. While easements are relatively common, they are often the subject of disputes—including disagreements over the scope of the easement and whether the property owner’s activities interfere with it. Disputes may also arise over whether an easement exists at all, as is sometimes the case with claims involving adverse possession.
Resolving an easement dispute often hinged on the language of the easement agreement. As such, the webinar emphasized the importance of clearly defining the easement and drafting strong provisions to protect clients. When disputes arose, counsel needed to guide their clients through settlement strategies to avoid litigation or, when necessary, implement effective litigation tactics.
The panel provided a comprehensive overview of real property easements and the types of disputes that frequently occur. They discussed drafting techniques to mitigate the risk of disputes—including how to define the easement with precision—and offered practical guidance for resolving or litigating disputes when they arise.
